Article 1 – Definitions

In these terms and conditions, the following terms have the meanings listed below:

  • Cancellation period: The 14-day period within which the consumer can exercise their right of cancellation. Products can only be returned if they are unused, unopened, undamaged, and in their original packaging.
  • Consumer: The natural person who is not acting in the course of their commercial or self-employed professional activity.
  • Day: Calendar day.
  • Durable medium: Any medium that enables the storage of information in an accessible form for later retrieval.
  • Right of withdrawal: The consumer's right to withdraw from the distance selling contract within the withdrawal period.
  • Entrepreneur: Scentora BV.
  • Distance selling contract: A contract concluded exclusively through electronic communication.
  • General Terms and Conditions: These General Terms and Conditions.

Article 3 – Scope

These General Terms and Conditions apply to every offer from Scentora BV and to every contract concluded via the webshop.

The general terms and conditions will be made available to the consumer before the conclusion of the contract.

Should any provision be wholly or partially invalid, the remaining provisions shall remain fully effective.

Article 4 – The Offer

  • The offer contains a clear and complete description of the products offered.
  • Images are for illustrative purposes only and may differ from the actual product.
  • Obvious errors or mistakes are not binding on the entrepreneur.
  • All prices include VAT and exclude shipping costs, unless otherwise stated.

Article 5 – Conclusion of the Contract

  • The contract is concluded as soon as the consumer accepts the offer and has fully completed the ordering process.
  • After completing the order process, the consumer receives an order confirmation via email.
  • Scentora BV reserves the right to refuse orders or to stipulate additional conditions.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.

Returns are only permitted if the product:

  • Is unused
  • Is unopened
  • Is complete and undamaged
  • Is provided with an intact original seal

The cancellation must be communicated via email to info@apexia-cosmetics.com.

After cancellation, the product must be returned within 14 days.

Article 7 – Costs in Case of Cancellation

  • The consumer bears the costs of the return shipment.
  • Refunds will be issued within 14 days of receipt of the return, provided the return conditions are met.
  • Should the product not meet the return conditions, Scentora BV reserves the right to refuse or reduce the refund.

Article 8 – Exclusion of the Right of Withdrawal

For reasons of hygiene and health protection (cosmetics), products whose seal is damaged are excluded from the right of withdrawal.

Article 9 – Prices

  • All prices are valid for the stated offer period.
  • Price changes due to legal measures (e.g. VAT changes) will be passed on.
  • Subject to printing and typographical errors.

Article 10 – Warranty and Conformity

  • Scentora BV guarantees that the products comply with the agreement and the legal conformity requirements.
  • Defects must be reported in writing within 14 days of their discovery.
  • The statutory warranty remains fully in effect.

Article 11 – Delivery and Shipping

  • Orders are processed with care.
  • Delivery will take place within 2 working days, unless otherwise agreed.
  • Delivery will be made to the address provided by the customer.
  • The risk of loss or damage passes to the customer upon delivery.

Article 12 – Payment

  • Payment is made using the payment methods offered in the webshop.
  • Payment processing is handled via external payment service providers such as Mollie, Stripe, Klarna, or PayPal.
  • Scentora BV is not liable for disruptions at external payment service providers.
  • The customer is obliged to report any discrepancies in the payment details immediately.

Article 13 – Complaints Procedure

  • Complaints should be submitted via email to info@apexia-cosmetics.com within 7 days of discovery.
  • Complaints will be answered within 48 hours.

Article 14 – Use of the Webshop Platform (WooCommerce)

The Scentora BV webshop is hosted and technically maintained via the WooCommerce platform.

WooCommerce is third-party software. Scentora BV is not liable for disruptions or temporary unavailability caused by technical problems with WooCommerce or other third-party providers, unless caused by intent or gross negligence.

Article 15 – Liability

Scentora BV is not liable for indirect damages, consequential damages, or lost profits, unless mandatory legal provisions provide otherwise.

Liability is limited in any case to the value of the respective order.

Article 16 – Applicable Law

All agreements are subject to applicable law. They are governed exclusively by Dutch law, even if the consumer resides abroad.
